Basic Summary

Wedding Cakes

  • 4 months notice required.
  • Cancellations must be made at least 6 weeks before the event.
  • No Deposit, No booking.
  • Deposits are non-refundable within 6 weeks of the event.
  • The remaining balance must be paid in full no later than 14 calendar days prior to the event date.

Regular Cakes

  • 2 weeks notice required.
  • Cancellations must be made at least 1 week before the collection/delivery date.
  • No Deposit, No booking.
  • Deposits are non-refundable within 1 week of the order date.
  • The remaining balance must be paid in full no later than 7 calendar days prior to the event date.

1. Agreement & Contract Formation

1.1 By paying a deposit and/or making any payment towards an order with Mackays Jamaican Kitchen Ltd, the customer confirms that they have read, understood, and agreed to these Terms and Conditions in full.

1.2 Payment of a deposit constitutes acceptance of these Terms and forms a legally binding contract.

1.3 Orders placed by telephone, email, social media, website, or other remote methods are subject to these Terms.

2. Order Categories

Orders are divided into two categories:

  • Wedding Cakes
  • Celebration & Regular Cakes (Non-Wedding Orders)

Each category has separate payment and cancellation terms as set out below.

3. Wedding Cake Payments & Cancellation

3.1 Wedding cake orders must be placed no later than six (6) weeks prior to the event date.

3.2 Orders requested within six (6) weeks of the event date may be accepted at our discretion and may be subject to additional charges.

3.3 A non-refundable booking fee is required to secure a wedding cake order.

3.4 No wedding booking is confirmed until the booking fee has been received in cleared funds.

3.5 The booking fee covers date reservation, consultation and design time, administrative work, and loss of opportunity to accept alternative bookings.

3.6 The remaining balance must be paid in full no later than 14 calendar days prior to the event date.

3.7 Failure to pay the balance by the due date may result in the contract being treated as cancelled by the customer and cancellation charges applied as follows:

  • More than 12 weeks before the event date: Booking fee retained only.
  • Between 12 and 8 weeks before the event date: 50% of total order value payable.
  • Between 8 and 4 weeks before the event date: 75% of total order value payable.
  • Less than 4 weeks before the event date: 100% of total order value payable.

3.8 Cancellation charges shall not exceed sums paid by the customer at the date of cancellation.

3.9 These charges represent a genuine pre-estimate of loss and are not intended to operate as a penalty.

3.10 Nothing in this clause affects statutory rights where goods are faulty or not as described.

3.11 Production is deemed to have commenced when ingredients or bespoke materials are ordered, structural or decorative elements are prepared, design work begins, or baking/assembly starts. Once production has commenced, cancellation rights are limited under the Consumer Contracts Regulations 2013 relating to personalised goods.

4. Celebration & Regular Cake Payments & Cancellation

  • 4.1 Celebration & Regular Cake orders must be placed no later than fourteen (14) days prior to collection or delivery.
  • 4.2 Orders requested within fourteen (14) days may be accepted at our discretion and may be subject to additional charges.
  • 4.3 A deposit is required to secure all bookings.
  • 4.4 No order is confirmed until the deposit has been received.
  • 4.5 The remaining balance must be paid in full no later than 7 days prior to collection or delivery.
  • 4.6 Failure to pay may result in cancellation and retention of the deposit.
  • 4.7 A minimum of 7 days’ written notice is required for cancellations.
  • 4.8 Where cancellation occurs less than 7 days before collection/delivery, cancellation charges up to 100% of the order value may apply depending on production stage and costs incurred.
  • 4.9 Where cancellation occurs more than 7 days before collection/delivery, the deposit is retained and additional sums paid will be refunded minus demonstrable costs already incurred.
  • 4.10 Orders placed within 7 days of collection/delivery are considered last-minute orders and may be subject to cancellation charges up to 100%, subject to statutory consumer rights.

5. Production Commencement & Bespoke Goods

  • 5.1 All cakes are bespoke, made-to-order goods created to the customer’s specification.
  • 5.2 Under the Consumer Contracts Regulations 2013, personalised goods are exempt from the standard 14-day cancellation period once production has commenced.
  • 5.3 Nothing in these Terms excludes or limits statutory rights under the Consumer Rights Act 2015.

6. Allergens & Food Law Compliance

6.1 All cakes are prepared in a kitchen where the 14 major allergens are handled:

  • Cereals containing gluten (wheat, rye, barley, oats, spelt)
  • Crustaceans
  • Eggs
  • Fish
  • Peanuts
  • Soybeans
  • Milk
  • Tree nuts (almonds, hazelnuts, walnuts, cashews, pecans, Brazil nuts, pistachios, macadamia)
  • Celery
  • Mustard
  • Sesame
  • Sulphur dioxide / sulphites
  • Lupin
  • Molluscs

6.2 All cakes are produced in compliance with the Food Safety Act 1990, the Food Safety and Hygiene (England) Regulations 2013, and the Food Information Regulations 2014, including Natasha’s Law for PPDS items.

6.3 While strict procedures are followed to minimise cross-contamination, complete absence of trace allergens cannot be guaranteed.

6.4 Customers must inform Mackays Jamaican Kitchen Ltd of allergy requirements at the time of ordering. Failure to disclose allergy information releases Mackays Jamaican Kitchen Ltd from liability for undisclosed allergies.

6.5 Ingredient and allergen information is available upon request in accordance with UK law.

6.6 It is the customer’s responsibility to communicate allergen information to guests or third parties consuming the cake.

7. Design, Collection, Delivery & Storage

  • 7.1 All cakes are handmade and may vary slightly from reference images.
  • 7.2 Exact colour matching cannot be guaranteed.
  • 7.3 Non-edible decorations must be removed before consumption.
  • 7.4 Risk transfers to the customer upon collection or, for delivered cakes, upon delivery to the agreed address.
  • 7.5 Mackays Jamaican Kitchen Ltd is not liable for damage occurring after risk has transferred.
  • 7.6 Cakes must be stored as advised at the time of collection/delivery.
  • 7.7 No liability is accepted for deterioration, contamination, or damage resulting from failure to follow storage instructions.

8. Complaints Procedure

  • 8.1 Any issue must be reported within 24 hours of collection/delivery.
  • 8.2 The product must be returned (where reasonable) for inspection.
  • 8.3 Refunds will not be issued where:
    • The cake has been substantially consumed;
    • The cake has been damaged after risk transfer;
    • The complaint relates to agreed design elements.

9. Force Majeure

  • 9.1 Mackays Jamaican Kitchen Ltd shall not be liable for failure or delay due to circumstances beyond reasonable control.
  • 9.2 Where performance becomes impossible due to force majeure, refunds will be limited to sums paid less demonstrable costs incurred.

10. Limitation of Liability

  • 10.1 Nothing excludes liability for death or personal injury caused by negligence, fraud, or any liability that cannot legally be excluded.
  • 10.2 Subject to this, liability is limited to the total order value.
  • 10.3 Indirect or consequential losses are excluded to the extent permitted by law.

11. Photography & Marketing

Products may be photographed for portfolio and promotional use. No personal data will be published without consent. Customers may opt out in writing at booking.

12. Privacy & Data Protection

Personal data is processed in accordance with UK GDPR and the Data Protection Act 2018 for order fulfilment, payment processing, communication, and legal compliance.

Customers may request access, correction, or erasure of personal data where applicable.

13. Retraction of Cancellation

Once a written cancellation request is received, the order is deemed cancelled. Any reinstatement is treated as a new booking subject to availability, revised pricing, and payment of a new deposit.

14. Governing Law & Severability

  • 14.1 These Terms are governed by the laws of England and Wales.
  • 14.2 If any provision is found unenforceable, the remainder shall remain in full force and effect.
